You must meet these conditions to use our Services:

  • You are not barred by any law from using Services in your country.

If you act on behalf of a business or organization, you confirm you have authority to bind that entity.

Account, Credentials & Security

  • To access certain parts of our Services, you must create an Account with truthful, current and complete information.

  • You are responsible for safeguarding your login credentials. Do not share them.

  • You must promptly update any changes to your information.

  • You agree to notify us immediately of any unauthorized use of your Account or security breach.

  • We are not liable for losses caused by unauthorized access or misuse of your account.

Use of Services & Acceptable Conduct

  • All the content, branding, software, designs, code, and logos on our website (except your user content) are owned by or licensed to Host Nimble.

  • You may not copy, distribute, or otherwise exploit our content, except as allowed under a license we grant you (e.g., use of templates or themes we provide as part of your hosting plan).

Fees, Payments, and Auto-Renewal

  • Our Services are subscription-based (monthly, yearly, or others).

  • You agree to pay all fees on time and in the currency and payment method we support.

  • We may add applicable taxes, duties or charges as required by law.

  • Unless you disable auto-renewal, your subscription will automatically renew at the end of each term.

  • If we cannot successfully charge your default payment method, Services may be suspended or terminated.

  • We reserve the right to change our pricing; such changes may apply for renewals.

  • Refunds are handled per our Refund Policy.

Availability, Maintenance & Interruptions

  • We aim for high uptime, but do not guarantee uninterrupted service.

  • We may perform maintenance, upgrades, or experience outages beyond our control. We are not liable for downtime or data loss from such events.

  • In rare cases, we may offer Beta or trial features. These are offered “as is” and may have bugs; you use them at your own risk.

Termination & Suspension

We may suspend or terminate your account or Services at any time, without notice or liability, for reasons including (but not limited to):

  • Violation of these Terms;

  • Non-payment;

  • Security or abuse concerns;

  • Legal orders or obligations;

  • Business decisions (e.g. discontinuing a feature).

Upon termination, you lose access to your data and services; you should download your data before termination.

Disclaimers & Limitation of Liability

  • All Services and content are provided “as is” and “as available” without warranties of any kind (unless local law prohibits).

  • To the maximum extent permitted by law, we disclaim all implied warranties (merchantability, fitness for a purpose, non-infringement).

  • We are not responsible for indirect, incidental, consequential, or punitive damages arising from your use (or inability to use) the Services.

  • Our liability is limited to direct damages up to the total amount you have paid us in the past 12 months (or a smaller amount if prohibited by law).

  • Nothing in this section excludes liability for death or personal injury caused by our negligence, or fraud or other acts which cannot legally be limited.

Indemnification

You agree to defend, indemnify, and hold Host Nimble and its officers, employees, agents harmless from any claim, liability, loss, damage, cost or expense (including legal fees) arising from:

  • Your use of Services;

  • Your breach of these Terms;

  • Claims based on your User Content or your acts or omissions.

Changes to Terms

We may change or update these Terms at any time. Notice of material changes may be provided via email or on the website. Your continued use after the change means you accept the new Terms. If you disagree, you may terminate your account.

Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the country/jurisdiction where Host Nimble is incorporated (you should specify).

  • Disputes are to be resolved via negotiation first; if unresolved, by arbitration or the courts of (your jurisdiction).

  • If any part of these Terms is held invalid or unenforceable, remaining parts will remain in effect.
